Terms of Service

The agreement between you and Luis Gaytan d/b/a TechieDodo Web Design Studio covering your use of Reputation Snapshot.

1. Agreement to these terms

Reputation Snapshot (the “Service”) is operated by Luis Gaytan d/b/a TechieDodo Web Design Studio (“we”, “us”, “our”). By creating an account or using the Service you agree to these Terms of Service (the “Terms”). If you are agreeing on behalf of a company, you confirm you have authority to bind that company, and “you” refers to it.

If you do not agree to these Terms, do not use the Service. Our Privacy Policy is incorporated into these Terms by reference.

2. What the Service does

The Service helps marketing agencies, consultants, and freelancers identify local businesses with weak online reputations and produce audit reports about them. It works by:

  • Retrieving publicly available business listing information through the Google Places API
  • Calculating scores from that information, including a Reputation Health Index and an Opportunity Score
  • Optionally measuring a business website’s performance through the Google PageSpeed Insights API
  • Optionally generating written analysis using Anthropic’s Claude models through an API key that you supply
  • Producing PDF and CSV reports, and tracking the status of your outreach

3. Eligibility and your account

You must be at least 18 years old and capable of forming a binding contract. You agree to provide accurate registration information and to keep it current.

You are responsible for all activity under your account and for keeping your credentials secure. Notify us at help@techiedodo.com promptly if you believe your account has been compromised. Accounts are for a single user; do not share login credentials.

4. Plans, billing, and cancellation

The Service is offered on a free plan and on paid subscription plans. Current plan limits are:

Paid plans are billed monthly or annually in advance through Stripe, our payment processor. Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. You authorize us to charge your payment method on each renewal.

You can cancel at any time from the billing page in your account, which opens the Stripe customer portal. Cancellation takes effect at the end of the current billing period; you keep access until then. Except where required by law, fees already paid are non-refundable and we do not provide partial refunds for unused time.

We may change prices with at least 30 days’ notice before the change applies to your next renewal. If you do not agree, you may cancel before the renewal date.

If a payment fails, we may suspend access to paid features until the balance is settled. Prices exclude taxes unless stated; you are responsible for any applicable taxes.

5. Your Anthropic API key

AI features require you to supply your own Anthropic API key. That key is encrypted before storage and used only to generate reports you request. You may remove it at any time from your settings.

Because the key is yours, you hold the account relationship with Anthropic. You are responsible for all usage charges Anthropic bills you, and for complying with Anthropic’s own terms and usage policies. We are not a party to that relationship and do not control Anthropic’s pricing, availability, or model behavior.

6. Acceptable use

You agree not to:

  • Use the Service to send unlawful, deceptive, or unsolicited bulk communications
  • Misrepresent the source, authorship, or accuracy of any report you generate or send
  • Attempt to circumvent plan limits, rate limits, or access controls, including by creating multiple accounts
  • Resell, sublicense, or provide the Service itself to third parties as a competing product
  • Scrape, bulk-export, or redistribute business data obtained through the Service other than as part of your own client work
  • Reverse engineer the Service, or access it by automated means other than features we provide
  • Upload unlawful or infringing content, including logos or branding you do not have the right to use
  • Interfere with the Service’s operation or place an unreasonable load on our infrastructure

Outreach compliance is your responsibility. The Service helps you produce material you may send to businesses, but it does not send anything on your behalf. You alone are responsible for complying with all laws that apply to your outreach, including the CAN-SPAM Act, CASL, the Telephone Consumer Protection Act, the UK PECR, and the GDPR, as applicable to you and your recipients.

7. Third-party data and services

Business information in the Service is retrieved from third-party sources, principally the Google Places API, and website performance data from the Google PageSpeed Insights API. Your use of that data is also subject to Google’s terms. We do not control, verify, or warrant the accuracy, completeness, or timeliness of third-party data, and it may be outdated or wrong.

The Service depends on third-party providers including Supabase, Stripe, Google, and Anthropic. Interruptions in those services may interrupt the Service.

8. Scores, reports, and AI output

Scores produced by the Service are calculated using our own methodology from limited public signals. They are estimates and opinions, not statements of fact, and some components are approximations derived from the data available. They do not represent a certification, audit, credit assessment, or professional valuation of any business.

AI-generated text may contain errors, omissions, or statements that do not accurately reflect a business. You must review every report before sending it to a prospect or client. You are solely responsible for the content of any report you distribute, including reports carrying your own branding, and for any claim arising from it.

Nothing produced by the Service is legal, financial, or professional advice.

9. Your content and your reports

You retain ownership of the content you supply — your notes, your agency name and logo, and your client-facing materials. You grant us a limited licence to host, process, and display that content solely to operate the Service for you.

As between you and us, you may use the reports you generate for your own business purposes, including delivering them to your clients under your own branding where your plan permits.

10. Our intellectual property

We own the Service, including its software, scoring methodology, report templates, design, and trademarks. These Terms grant you a limited, non-exclusive, non-transferable, revocable right to use the Service while your account is in good standing. No other rights are granted.

If you send us feedback or suggestions, we may use them without obligation or compensation to you.

11. Availability and changes

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time. We apply rate limits to protect the Service, and we may adjust them.

If we discontinue the Service entirely, we will give reasonable notice and a period in which to export your data.

12. Suspension and termination

You may stop using the Service at any time and may delete your account from your settings, which permanently deletes your data as described in the Privacy Policy.

We may suspend or terminate your account if you materially breach these Terms, if your use creates risk or legal exposure for us or others, or if payment is overdue. Where practical and lawful we will give notice and an opportunity to cure. Sections that by their nature should survive termination — including sections 8, 10, 13, 14, 15, and 17 — do so.

13. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will meet your requirements, that scores or reports will be accurate, or that using the Service will generate leads, clients, or revenue.

14. Limitation of liability

To the fullest extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, lost revenue, lost business, or lost data, even if advised of the possibility.

Our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) one hundred US dollars.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Luis Gaytan d/b/a TechieDodo Web Design Studio and its officers, employees, and agents from any claim, damage, loss, or expense (including reasonable legal fees) arising from your use of the Service, your outreach activity, the reports you distribute, your content, or your breach of these Terms.

16. Changes to these Terms

We may update these Terms from time to time. If a change is material we will give reasonable notice, such as by email or an in-product notice, before it takes effect. Continuing to use the Service after the effective date means you accept the updated Terms.

17. Governing law and disputes

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. The courts located in Los Angeles County, California have exclusive jurisdiction over any dispute, and both parties consent to that venue.

18. General

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
